Terms and conditions of use

1. Who is responsible
Akemix is a product of Juan Andrés Torres Orozco, a natural person, holder of Colombian ID (cédula de ciudadanía) 1.235.140.238, domiciled at Carrera 32 con Calle 32 #32-28, Buenaventura, Valle del Cauca, Colombia.

2. Acceptance
By downloading or using Akemix Server or the Akemix app you accept these terms. If you do not agree, do not use the software. Continued use after a change implies acceptance; changes are published on this page with their date.
3. Licence
You are granted a personal, non-exclusive and non-transferable licence to use the software. The free version can be used with no time limit, subject to the functional restrictions published on the pricing page.
The Pro licence is assigned to one server installation. Reselling, renting, sublicensing or redistributing the software or its activation keys is not permitted.
4. Restrictions
You may not reverse engineer, decompile or modify the software, except to the extent expressly permitted by applicable law. You may not remove intellectual property notices, nor use the Akemix name in derivative products without written authorisation.
5. Content and recordings
The audio you capture, mix or record is yours. Akemix does not access it and does not transmit it outside your local network.
You are responsible for obtaining consent from the people whose audio is captured. In Colombia, recording someone without their authorisation may infringe their right to privacy and to their own image.
6. Price, payment and invoicing
The Pro licence costs 19 US dollars, a one-off payment that includes updates within the current major version.
Payment is processed by Lemon Squeezy, which acts as merchant of record for the transaction and issues the corresponding receipt. Akemix never receives or stores your card details.
7. Withdrawal, payment reversal and warranty
As this is a distance sale, you have the right of withdrawal for five business days after purchase, under article 47 of Colombian Law 1480 of 2011. To exercise it, simply write to soporte@akemix.app within that period: the full amount is refunded and you do not have to give a reason.
You are also entitled to the payment reversal of article 51 of the same law, and to the statutory warranty of article 7: if the software does not work as advertised, you are entitled to have it repaired, replaced, or your money returned.
8. Warranty and liability
Beyond the statutory warranties that cannot be excluded, the software is provided as is. It is not guaranteed to run without interruption on any network, machine or configuration: latency and stability depend on your WiFi network, which is outside our control.
We are not liable for lost recordings, loss of profit or indirect damages arising from use of the software, to the extent Colombian law permits that limitation.
9. Intellectual property
The software, the documentation and the Akemix name belong to their owner. Akemix is not registered as a trademark before the Colombian Superintendence of Industry and Commerce, which does not affect copyright over the software.
The software includes third-party libraries under open licences, whose authorship is credited on the About screen of the application.
10. Termination
The licence terminates if you breach these terms. In that case you must stop using the software and remove it from your machines. What is agreed on intellectual property, liability and applicable law survives termination.
11. Applicable law and disputes
These terms are governed by Colombian law. Any dispute will be submitted to the courts of Buenaventura, Valle del Cauca, without prejudice to your right as a consumer to approach the Superintendence of Industry and Commerce.
